Travel Arrangement Terms Explanation Document
This document is the Explanatory Document for Transaction Terms and Conditions as stipulated in Article 12-4 of the Travel Agency Law. When a travel contract is established, this document will become a part of the contract document in accordance with Article 12-5 of the same law.
Sharing Kyoto Inc. ("Our company") accepts travel arrangement services at the request of the customer. In such cases, the conditions described in this "Transaction Terms and Conditions Explanatory Document" and matters not described in the "Transaction Terms and Conditions Explanatory Document" shall be governed by Our company's General Terms and Conditions of Travel Agency Contract ("Company Agreement") as described in the Travel Itinerary. 1 Application and formation of contract
(1) When applying for a trip, please register for "Premium Member Registration" on Our company's designated website or in writing. At that time, please fill out the necessary information and apply to Our company by any electronic media or in writing after confirming the necessary consent. After registering as a Premium Member, please apply for arranged tours on the website, by e-mail, or in writing.
(2) When applying, please fill out the necessary information in the document prescribed by Our company and submit it with the application fee. The application fee shall be part of the travel fee (defined in paragraph 3. The same shall apply hereinafter).
The contracts shall come into effect when Our company accepts the formation of the contract and receives the application fee, except in cases where Our company concludes a special agreement in writing. However, in the event that a train ticket and an accommodation ticket are given in exchange for the tour fee, an oral application may be accepted. In such a case, the contract shall be formed when Our company accepts the formation of the contract.
(3) Our company accepts payment of part of the travel fee (application fee), etc., without the member's signature, from the card member ("Member") of the credit card company with which Our company has an alliance ("affiliated company"). On the condition that it is received, a travel contract may be concluded by telephone, e-mail, facsimile, the Internet or other means of communication (hereinafter referred to as a correspondence contract). However, in some cases, we may not be able to accept such requests due to business reasons, such as our company not having a franchise agreement with a partner company that includes an unsigned handling special agreement.
A correspondence contract shall be established when a notice of completion of arrangements by Our company, is delivered to the customer. However, even if the customer is unable to confirm the reservation completion screen due to a malfunction of the receiving terminal or other circumstances on the customer's side despite Our company's transmission of "Arrangement Completion'' data on its website or by e-mail, etc., the contract will be formed. If the customer is unable to confirm the completion of the reservation after submitting the reservation request, the customer should confirm the reservation by himself using the "Confirmation/Cancellation of Arrangement'' on the website or contact Our company for confirmation.
If the customer wishes to pay by credit card and the credit card company is unable to process the payment, Our company will refuse the application.
2 Conditions for application
(1) Those with health problems, those who use wheelchairs or other equipment, those with physical or mental disabilities, those with food or animal allergies, those who are pregnant or may be pregnant, those with assistance dogs for the physically disabled (guide dogs, service dogs), or those who require other special considerations must inform us at the time of application that they require special consideration in order to participate in the tour. (If such a request is made after the tour contract has been established, the tour operator will not be responsible for any damage caused by such conditions. (Please also inform us immediately if you become in such a condition after the establishment of the tour contract.)
(2) If Our company receives a request as described in the preceding item, it will comply with the request to the extent possible and reasonable. In this case, we may inquire about the customer's situation and the necessary measures, or we may ask the customer to provide such information in writing.
(3) If a customer is found to be a member of a crime organization, a person related to a crime organization, or any other anti-social entity, or if the customer engages in violent or unreasonable demanding behavior, threatening language or violence toward Our company, or if the customer spreads rumors, uses false information or force to discredit Our company or obstruct its business, or if the customer engages in any other similar behavior, we may refuse your application.
(4) If you are under 18 years of age, you must obtain the consent of a person with parental authority.
(5) We reserve the right to refuse applications for other business reasons.
3 Travel Service Handling Charges
In addition to the fares, charges, and other expenses for transportation, accommodation, etc. paid by the customer, Our company shall charge the following travel service handling fees for making, changing, or canceling reservations, arranging sightseeing tickets, etc., which Our company accepts as part of the customer's trip. The travel expenses and travel service charges are hereinafter collectively referred to as the “Travel Expenses.”

1. Requests for change or cancellation shall be accepted only during our business hours.
2. Cancellation fees, refund fees, etc., as specified by the relevant transportation agency, sightseeing facility, etc., for changed or cancelled transportation or sightseeing tickets, etc., shall be paid by the customer.
3. Transportation and accommodation expenses for tour guides will be charged separately.
4. The above fees do not include telephone charges, communication charges, shipping charges, and other actual expenses. Actual communication expenses may be charged separately.
4 Tour fees
(1) As a general rule, the tour fee shall be paid by the date specified by Our company prior to the commencement of the tour. If this is not the case, the date and method of payment shall be clearly indicated in the itinerary and other documents.
(2) Even after the contract has been established, Our company reserves the right to change the tour fee in the event that the price of the tour changes due to revisions in fares and charges of transportation facilities, fluctuations in exchange rates, or other reasons.
5 Changes to the contents of the travel contract
If the customer wishes to change the contents of the contract, Our company will comply with the request as much as possible. In such cases, the tour fee may be changed. In addition, the following charges must be paid.
(1) Cancellation fees and other change fees for transportation services shall be paid by the customer to the relevant service provider.
(2) Change procedure fee for tour services as specified by Our company
6 Cancellation of Travel Contract
(1) If the costumer cancels the tour contract, the following charges to the service provider shall be pay by the costumer.
1 Fees for travel services you have already received
2 Cancellation fees, penalty fees, and other fees to be paid to the service providers for the tour services which the costumer has not yet received
(2) Cancellation fee for tour services

(3) If the customer is found to be a member of a crime organization, a person related to a crime organization, or any other antisocial entity, or if the customer engages in any violent or unreasonable demand, threatening behavior, or use of violence against Our company, or if the customer spreads rumors, uses force to discredit Our company or obstruct its business, etc. Our company may cancel the tour contract. In such cases, please pay the fees stipulated in the preceding two items.
7 Organizations and group arrangements
A travel contract applied for by multiple travelers traveling on the same itinerary at the same time (hereinafter referred to as "members") by appointing a responsible representative shall be handled as follows.
(1) Our company shall deem that the representative designated by the customer (hereinafter referred to as the "Responsible Contractor") has the authority to act on behalf of Our company in all matters relating to the conclusion of a tour contract with the Members, and shall conduct transactions, etc. relating to said tour contract with the Responsible Contractor.
(2) Our company shall not be liable for any debt or obligation that the Responsible Contractor now owes or is expected to owe to the Members in the future.
(3) The Responsible Contractor shall submit a list of the constituent members by the date specified by Our company after the establishment of the contract. The Responsible Contractor shall obtain the consent of the constituent members themselves for the provision of the information to a third party in accordance with Paragraph 9.
(4) If the Responsible Contractor does not accompany the group at the start of the tour, a member appointed by the Responsible Contractor shall be the person responsible.
(5) If the Responsible Contractor requests a change in the members of the group, we will comply with the request as much as possible. Any increase or decrease in the tour fee resulting from a change in the members shall belong to the members.
(6) The operation of the tour shall be conducted by the customer himself. However, upon request of the Responsible Contractor, we will provide tour service upon payment of the prescribed tour service fee. The tour guide services shall, in principle, be those necessary for group activities in accordance with the predetermined itinerary. The tour guide shall perform such services in accordance with the instructions of the Responsible Contractor. The tour guide's work hours shall be from 8:00 a.m. to 8:00 p.m.
8 Our Liability, Indemnification and Disclaimer
(1) Our liability and compensation for damages
In the event that Our company or its agents intentionally or negligently cause damage to the customer in the performance of the tour contract, Our company shall compensate for such damage. However, this will be limited to cases where a claim is made within 2 years from the day following the occurrence of the damage. In the case of damage to baggage, Our company will compensate up to 150,000 yen per traveler (except in the case of willful misconduct or gross negligence on the part of Our company) if Our company is notified of such damage within 14 days from the day following the day on which the damage occurred.
(2) Responsibility for Arrangements
When we have made arrangements for the tour services described in the contract document with the "due care of a good manager", the performance of our obligation shall be deemed to have been completed.
(3) Disclaimer
Our company shall not be liable for compensation under the preceding paragraph if, for example, the customer suffers damages due to any of the following reasons
1 Damages caused by natural disaster, war, riot, order of government authorities, fire, or suspension of services provided by transportation or accommodation agencies, etc.
2 Food poisoning
3 Damage caused by the Costumer's own negligence
4 Damages due to any other reasons beyond the control of Our company or its agents
(4) Customer Responsibilities
1 If our company suffers damage due to the customer's intention or negligence, we will receive compensation for damages from the customer.
2 In the event that a customer violates these terms and conditions, uses this website fraudulently or illegally, or Our company deems that the customer has not entered true and accurate data, Our company may cancel the relevant unfulfilled reservation without prior notice and refuse the customer's use of this website in the future. Our company shall not be obliged to disclose the reason for such cancellation.
3 The customer shall be responsible for compensating for any damages (including the money borne by Our company to the destination, etc.) incurred by Our company due to the actions in the preceding item.
9 Handling of Personal Information
(1) When accepting a travel application, Our company shall obtain the customer's personal information for the prescribed items. However, if the customer does not provide all or part of his personal information, Our company may not be able to accept the customer's application or request if Our company is unable to contact the customer or take necessary procedures to arrange and receive travel services. In such cases, we may not be able to accept the customer's application or request. Personal information obtained will be handled by the travel service manager on behalf of the personal information manager.
(2) In addition to using the personal information acquired in accordance with the preceding item for the purpose of communication with the customer, Our company may provide the personal information to the extent necessary for the arrangement of travel services and procedures for receiving such services on the trip applied for by the customer and for the convenience of the customer for shopping at souvenir stores in the travel destination. We may provide the personal information acquired in accordance with the preceding item and personal data pertaining to the flight number of the passenger to transportation agencies, insurance companies, government offices, and stores by sending such data by electronic means in advance. In addition, we may use the personal information acquired in accordance with the preceding item, as well as our website browsing history, purchase history, and other personal information, for the following purposes.
1 Information on products, services, and campaigns of our affiliated companies
2 Requests for opinions and feedback after participation in a tour
3 Requests for questionnaires
4 Provision of special services
5 We may use your personal information for the purpose of preparing statistical data.
(3) In case of illness or accident during the tour, we may ask for personal information to your contact person. This personal information will be used when we recognize that it is necessary to communicate with the contact person if the customer has an illness.
The customer shall obtain the consent of the contact person to provide the contact person's personal information to Our company and others.
(4) In the case of itinerary management services such as arrangement agency services and tour guide services, etc., we may outsource part, or all of the handling personal information acquired in accordance with item (1) of this section to a third party. In such cases, we will select the relevant consignee company in accordance with our standards and entrust personal information to them after signing a confidentiality agreement.
(5) Our company shall promptly respond to requests from customers for notification of purpose of use, disclosure, correction, addition, deletion, suspension of use, elimination, or record of provision to a third party.
10 Other
It is strictly prohibited to use or resell the tickets, booked through the arranged tour contract with our company for commercial purposes. In the unlikely event that Our company determines that an act is for the purpose of profit-making or preparation, the arranged tour contract may be cancelled without prior notice.

Travel Consultation Terms Explanation Document
Sharing Kyoto Inc. ( "Our company") shall undertake travel consultation services at the request of our customers. In this case, the terms and conditions described in this Travel Consultation Terms Explanation Document and matters not described therein shall be according to the Travel Agency Terms and Conditions, Travel Consultation Contract Section ( "Company's Terms and Conditions").

1. Application and Conclusion of Contract
(1) When applying for travel consultation, please register as a "Premium Member" on Our company's designated website or in writing. In this case, please fill out the necessary items and confirm the necessary consent before submitting the application to Our company by electromagnetic means or in writing.
After registering as a Premium Member, please submit your request for travel consultation on our website, by email, etc., or in writing.
(2) The contract for tour consultation is established when Our company accepts the conclusion of the contract and accepts the application form.
(3) Our company may accept an application for a travel consultation contract by telephone, internet, or other means of communication without receiving an application form. In such a case, the contract shall be established at the time of Our company's acceptance.
2. Application Requirements
Our company may not accept the conclusion of a travel consultation contract in the following cases:
(1) If the content of your consultation is against public order and morals
(2) If the content of your consultation is likely to violate the laws and regulations in force in the travel destination
(3) If you are found to be a member of a crime syndicate, a person related to a crime syndicate, or of other antisocial forces, if you engage in violent or unreasonable acts of demand, threatening language, or violence toward Our company, if you spread rumors, use false information or force to damage Our company's reputation or obstruct its business, or if you engage in any of these acts.
(4) If you are a person under 18 years of age and do not have the consent of a person with parental authority.
(5) In any other cases concerning Our company's business.
3. Travel Service Fees
Our company shall undertake the following travel business consultations at the request of the customer. In such a case, the travel consultation fees below will be charged:

Note:
1. The above fees do not include telephone charges, communication costs, shipping costs, and other costs incurred. Actual communication costs may be charged separately.
2. The applicable fees listed above shall be added together.
4. Our Liability and Indemnity/Disclaimer of Liability
(1) If, in the performance of the travel consultation contract, Our company intentionally or negligently causes damage to the customer, Our company shall compensate for such damage, provided that the customer has notified Our company of the damage within 6 months from the following day of the occurrence of the damage.
(2) Our company does not guarantee that the transportation and accommodation facilities described in the travel plan prepared by Our company will be, in reality, arrangeable. Therefore, Our company shall not be responsible if you cannot make a reservation due to full capacity or other reasons.
5. Handling of Personal Information
(1) When accepting an application for travel consultation, Our company shall obtain the customer's personal information on the prescribed items. Although it is up to the customer to select the items of personal information to be provided to Our company, we may not be able to accept the customer's application or request if all or part of the personal information is not provided and if we are unable to contact the customer or take the necessary procedures to provide travel services.
The personal information obtained shall be handled by the Travel Service Supervisor on behalf of the personal information manager.
(2) Other than using the personal information acquired in accordance with the preceding item for the purpose of contacting the customer, Our company shall, for arranging travel services or procedures for receiving such services on the tour pertaining to the travel consultation for which the customer has applied and providing customers with shopping and other conveniences at souvenir stores in the travel destination to the extent necessary for the customer, provide personal information acquired in accordance with the preceding item and personal data pertaining to the flight number of the passenger to transportation agencies, insurance companies, government offices, and stores. In addition, we may use the personal information acquired as described in the preceding item, as well as personal information such as your website browsing history and purchase history, for the following purposes:
1 Guidance on products, services, and campaigns of our affiliated companies
2 Request to provide opinions and feedback after participating in the tour
3 Request for questionnaire
4 Provision of special services
5 Preparation of statistical materials
(3) In case of illness or accident during the tour, Our company may ask for the personal information of the contact person of the customer. This personal information will be used in the event that Our company deems it necessary to contact the contact person in the event of illness, etc. of the passenger. As the customer, you shall obtain the consent of the contact person to provide the contact person's personal information to us.
(4) When a customer requests notification of the purpose of use, disclosure, correction, addition, deletion, suspension of use, elimination, or record of provision to a third party, Our company shall promptly respond to such request.
